Services Provided

1.1 Our company specializes in custom boat building, maintenance, and repair services. 1.2 We offer a range of pre-designed boats for sale. 1.3 All services are subject to availability and may be withdrawn at our discretion.

Estimates and Payments

2.1 Estimates: All cost estimates provided are subject to change based on design modifications and material selections. 2.2 Payments: A deposit is required to begin the project, with the remaining balance due upon completion. Payment schedules will be discussed and agreed upon before the start of any project. 2.3 Additional Costs: Any changes or modifications requested after the initial agreement may result in additional charges.

Warranty and Liability

3.1 Warranty: We provide warranty on all new boats constructed by us. This warranty covers material and workmanship defects. 3.2 Liability: Our liability is limited to the repair or replacement of defective parts. We are not responsible for any indirect, incidental, or consequential damages. 3.3 Warranty Exclusions: The warranty does not cover damage caused by misuse, negligence, or accidents.

Modifications and Customizations

4.1 Any modifications or customizations requested after the initial agreement may result in additional charges and extended project timelines. 4.2 All modifications and customizations are subject to our approval.

Delivery and Acceptance

5.1 Delivery: We will provide an estimated delivery date; however, unforeseen circumstances may cause delays. 5.2 Acceptance: Upon delivery, you are responsible for inspecting the boat. Any defects or issues must be reported within the stipulated days in the official agreement.

Cancellation and Refund Policy

6.1 Cancellation: If you wish to cancel the project, written notice is required. Cancellation fees may apply. 6.2 Refund: Refunds are subject to the stage of the project and any non-recoverable costs incurred by us. 6.3 Non-Refundable Deposit: The initial deposit is non-refundable unless the project is canceled by us.

Intellectual Property

7.1 All designs and specifications provided by us are our intellectual property. You may not reproduce, distribute, or use them without our written consent. 7.2 Any intellectual property created during the project remains our property unless otherwise agreed upon in writing.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Maldives. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Maldives.

Changes to Terms and Conditions

We reserve the right to modify these terms and conditions at any time. Any changes will be communicated to you, and your continued use of our services constitutes acceptance of the new terms.

Force Majeure

We are not liable for any delays or failures in performance resulting from events beyond our control, including natural disasters, labor strikes, or equipment failures.

Confidentiality

All confidential information shared between the parties must remain confidential and not be disclosed to any third party without prior written consent.

Dispute Resolution

Any disputes arising from these terms and conditions will be resolved through negotiation and, if necessary, arbitration in accordance with the rules of The Maldives International Arbitration Centre (MIAC).

Entire Agreement

These terms and conditions constitute the entire agreement between you and Al Shaali Marine Maldives Pvt. Ltd., superseding any prior agreements or understandings. The Official signed agreement shall supersede these terms.
